These Terms and Conditions apply when you visit or place an order through apexarcs.pk. The website is operated by Apex Arcs (“Apex Arcs”, “we”, “us” or “our”).

By using our website or placing an order, you agree to these Terms and Conditions. If you do not agree, please do not use the website. These Terms should be read together with our Privacy Policy, Shipping and Delivery Policy, and Return and Refund Policy.

1. Using our website

You agree to use the website lawfully and not to interfere with its operation, attempt unauthorized access, submit harmful code, or misuse another person’s account or information.

You are responsible for providing accurate and complete information when placing an order, including your contact details, delivery address and any files or instructions needed for a print-on-demand order. Please contact us promptly if you notice an error in your order details.

2. Products and descriptions

We make reasonable efforts to describe and display our books and services accurately. Images, colors and previews may appear differently depending on your device or screen. Minor variations in appearance may occur.

Product descriptions, prices and availability may change. If we discover a material error in a listing or price after you place an order, we will contact you to explain the issue and discuss the available options before proceeding.

3. Orders and payment

When you submit an order, you are making a request to purchase the listed products or services. We will send an order confirmation or other message to acknowledge receipt. We may be unable to accept or fulfill an order, for example if an item is unavailable, payment is not authorized, required information is missing, or there is a clear listing or pricing error. If we cannot fulfill an order after payment, we will contact you about the next steps, including any applicable refund.

Prices, delivery charges, taxes and available payment methods will be shown during checkout or communicated to you before payment. You are responsible for checking the order details and total before submitting your order.

Payment processing may be handled by a third-party payment provider. Its terms and privacy practices may also apply to the payment.

4. Print-on-demand orders

For print-on-demand services, you must provide the manuscript PDF, cover file, specifications and other materials we request in the format and manner we communicate to you. We may contact you if files are missing, unreadable, technically unsuitable or require clarification. Production may be delayed while we wait for corrected files or instructions.

Where we provide a proof or preview for approval, you are responsible for reviewing it carefully and confirming that it is ready for production. If you approve a proof, or instruct us to proceed without one, we will print according to the approved materials and instructions. Please contact us as soon as possible if you identify an error before production begins.

Printing may involve ordinary production tolerances, such as minor differences in colour, trimming or alignment. We will assess reported printing or production issues under our Return and Refund Policy.

5. Your submitted materials

You retain any rights you have in the manuscript, cover and other materials you submit. You confirm that you own or have permission to use, reproduce and print all materials you provide, and that your submission does not unlawfully infringe another person’s rights or violate applicable law.

You give Apex Arcs permission to access, store, copy and use your submitted materials only as reasonably necessary to assess, prepare, print, quality-check and fulfill your order, provide customer support, and keep necessary business records. We may share relevant files with a print or production provider where required to fulfill your order. Our handling of submitted files is also described in the Privacy Policy.

We may decline or pause an order if we reasonably believe the materials are unlawful, infringing, unsafe to handle, or unsuitable for printing, or if we need further information to proceed.

6. Delivery, cancellations and refunds

Delivery methods, estimated time frames, charges, delivery areas and related conditions are described in our Shipping and Delivery Policy. Delivery estimates are not guarantees unless we expressly state otherwise.

Cancellations, returns, replacements and refunds are handled under our Return and Refund Policy. Nothing in these Terms is intended to remove any rights that cannot legally be excluded.

7. Intellectual property on the website

Unless stated otherwise, the website and its content—including text, graphics, logos, design elements and product images—belong to Apex Arcs or are used with permission. You may use the website for personal, non-commercial shopping. You must not copy, republish, distribute, modify or commercially exploit website content without our prior written permission, except where permitted by law.

This section does not transfer ownership of customer-submitted manuscripts, covers or other materials to Apex Arcs.

8. Third-party services and links

Our website may link to third-party websites or use third-party services, such as payment or delivery services. These are operated by their respective providers and may be subject to separate terms and privacy policies. We are not responsible for third-party websites or services, except where applicable law provides otherwise.

9. Website availability

We work to keep the website available and functioning, but access may occasionally be interrupted for maintenance, updates, technical issues or circumstances outside our control. We may change or discontinue website features, listings or services. We will handle any affected paid order in accordance with these Terms and applicable policies.

10. Limitation of responsibility

To the extent permitted by applicable law, Apex Arcs is not responsible for indirect or consequential losses arising from use of the website or a delay or interruption beyond our reasonable control. We do not exclude or limit responsibility where doing so would be unlawful, and these Terms do not affect any consumer rights that cannot legally be excluded.

11. Changes to these Terms

We may update these Terms from time to time. The current version and its update date will be posted on this page. Updated Terms apply from the date they are posted to future use of the website and new orders. The terms that applied when an order was placed will continue to apply to that order, unless a change is required by law or agreed with you.

12. Governing law and disputes

These Terms are governed by the laws of Pakistan, without limiting any consumer rights that apply to you under mandatory law. Courts located in Pakistan will have jurisdiction, subject to any mandatory rights or procedures that apply.
